1. Acceptance of Terms

By accessing or using DankMinecraftServers.com ("the Site", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site. We reserve the right to modify these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.

2. Description of Service

DankMinecraftServers.com is a platform that allows users to discover, list, vote for, and promote Minecraft game servers. The Site provides free and premium listing services, voting functionality, server status monitoring, and analytics tools. We are not affiliated with, endorsed by, or connected to Mojang Studios, Microsoft Corporation, or any Minecraft server listed on the Site.

3. User Accounts

3.1 Registration: You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

3.2 Eligibility: You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Site.

3.3 Account Security: You must immediately notify us of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

3.4 Account Termination: We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms.

4. Server Listings

4.1 Accuracy: Server owners are solely responsible for the accuracy of their server listing information, including but not limited to server name, IP address, description, and category tags.

4.2 Ownership Verification: We may require server owners to verify ownership through MOTD verification or other means before a listing is made public.

4.3 Content Standards: Server listings must not contain content that is illegal, defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable. We reserve the right to remove or modify any listing at our discretion.

4.4 No Guarantee: We do not guarantee the availability, quality, safety, or legality of any server listed on the Site. Users connect to third-party servers at their own risk.

5. Voting

5.1 Fair Voting: Each user may vote for a server once every 24 hours per IP address. Any attempt to manipulate vote counts through automated means, multiple accounts, proxy services, VPNs, or any other method is strictly prohibited.

5.2 Vote Manipulation: We employ automated fraud detection systems. Servers found to be engaging in or benefiting from vote manipulation may have their votes reset, listings suspended, or accounts permanently banned without refund.

6. Premium Services & Payments

6.1 Paid Plans: We offer premium listing plans (Featured, Sponsored, Banner Ad) for a fee. Prices are displayed on the Site and may change at any time. Changes do not affect active subscriptions.

6.2 Payment Processing: Payments are processed through PayPal. By making a purchase, you also agree to PayPal's terms of service. We do not store your payment card information.

6.3 No Recurring Charges: Premium plans are one-time purchases for a specified duration. There are no automatic renewals unless explicitly stated.

6.4 Refund Policy: Payments are generally non-refundable. Refunds may be issued at our sole discretion in cases of technical error or service failure attributable to us. Refund requests must be submitted within 7 days of purchase. Refunds will not be issued for listings removed due to Terms violations.

6.5 Service Availability: We do not guarantee uninterrupted availability of premium features. We will make reasonable efforts to maintain service uptime but are not liable for temporary outages.

7. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Interfere with or disrupt the Site, servers, or networks connected to the Site
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or computer systems
  • Use bots, scrapers, or automated tools to access the Site without our written permission
  • Upload or transmit viruses, malware, or any other malicious code
  • Engage in vote manipulation, click fraud, or artificial inflation of any metrics
  • Harass, abuse, or threaten other users
  • List servers that promote illegal activity, distribute malware, or host content exploitative of minors
  • Circumvent any rate limits, security measures, or access controls
8. Intellectual Property

8.1 Our Content: The Site's design, code, text, graphics, logos, and other content are owned by DankMinecraftServers and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

8.2 User Content: By submitting content to the Site (server descriptions, banners, etc.), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the Site's services.

8.3 Trademarks: "Minecraft" is a trademark of Mojang Studios / Microsoft Corporation. All other trademarks are the property of their respective owners. Use of any trademarks on the Site does not imply endorsement.

9. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANKMINECRAFTSERVERS AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless DankMinecraftServers and its owners, operators, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Site.

The Site may contain links to third-party websites, servers, and services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your interaction with any third-party site is at your own risk and subject to that site's terms and policies.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are located in a jurisdiction that requires disputes to be resolved in local courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
